Caution when asserting claims outside Liechtenstein.
National civil procedure rulesoften allow a plaintiff to assert claims against a defendant not only at the defendant’s domicile (general rule of jurisdiction), but also at the plaintiff’s domicile or place of residence or elsewhere. Thereby the jurisdiction of courts in different countries can often be established. In such a case, there is a risk that the plaintiff conducts proceedings and obtains a judgment which he will not be able to enforce against the defendant, or only with considerable difficulty. Particularly in the relationship between Liechtenstein and Austria, there are considerable restrictions on the recognition and enforcement of foreign judgments.
