Lawyer’s duty to provide information about litigation financing: According to the case law of the Swiss Federal Supreme Court of 22.01.2015 (2C_818/2014), the proper fulfillment of the lawyer’s duty to provide information under professional law and contract law requires, in addition to the duty to provide information about the prospects of success, opportunities, risks and cost risks, the duty to inform the client about the possibility of litigation financing (SJZ 112 (2016) No. 2).

The Federal Supreme Court’s reasoning already indicates the general validity of this duty to inform and advise lawyers with regard to the possibility of litigation funding. In addition, the rules of professional conduct and the general rules of contract law require lawyers to provide their clients with comprehensive information. Accordingly, lawyers in Liechtenstein are also obliged to inform their clients not only about legal aid but also about the possibility of litigation funding.
